Establishing a Residential Rental Property Operating Permit Program & Requiring Owner Occupancy Requirements and other Provisions Associated with  Accessory Dwelling Units

The Town of Ithaca adopted legislation that will affect owners of residential rental property by expanding the town’s current operating permit program to include rented single family homes, accessory dwellings (apartments), and duplexes. The legislation also establishes an owner-occupancy requirement for newly constructed accessory dwelling units (ADUs), as well as other provisions pertaining to ADUs. The town currently requires operating permits for buildings with three or more dwelling units. 

The legislation stems from increasing public concern with rental properties and their impact on neighborhoods, as well as their code compliancy related to health and safety.  In response to these concerns, the town enacted a moratorium on the construction of new accessory dwellings to allow time to study the issues and consider ways to address concerns. The legislation is the result of these efforts and is similar to legislation that has been enacted by other communities throughout the state.
